Legal Situation in Germany



Eine Strafanzeige ist die Mitteilung eines Sachverhaltes an die zuständigen Strafverfolgungsbehörden, der nach Auffassung des Mitteilenden einen Straftatbestand erfüllen könnte. Die Strafanzeige ist von dem Strafantrag zu unterscheiden, der eine Prozessvoraussetzung ist.
Die Strafanzeige kann mündlich oder schriftlich bei der Polizei, bei einer Staatsanwaltschaft oder den Amtsgerichten erstattet werden.[1] Die mündliche Anzeige wird zu Protokoll („zur Niederschrift“) genommen. Bei bestimmten Straftaten (so genannte Antragsdelikte) ist neben der Erstattung der Strafanzeige außerdem innerhalb von drei Monaten ab Bekanntwerden des Täters durch den Geschädigten die Stellung eines Strafantrages erforderlich.
Sofern auf Grund der in der Strafanzeige mitgeteilten Tatsachen tatsächliche Anhaltspunkte vorliegen, dass ein Straftatbestand verwirklicht sein könnte (so genannter Anfangsverdacht), sind die Strafverfolgungsbehörden verpflichtet, der Anzeige nachzugehen und den Sachverhalt so weit als möglich aufzuklären. Hier gilt das Legalitätsprinzip für die Ermittlungsbehörde.
Die Anzeige wird von der Polizei per Abverfügung der Staatsanwaltschaft vorgelegt, innerdienstlich wird der Vorgang von der Polizei nach Abschluss der Ermittlungen „abverfügt“ (bei schwerwiegenden Straftaten erfolgen Nachgänge). Die Staatsanwaltschaft entscheidet nach Abschluss der Ermittlungen, ob gegen den Beschuldigten Anklage erhoben wird oder das Verfahren eingestellt wird. Im letzten Fall erhält der Anzeigeerstatter einen schriftlichen Bescheid.[2] Der Anzeigeerstatter kann gegen die Einstellung Beschwerde einlegen. Über diese entscheidet dann die dienstvorgesetzte Behörde, die Generalstaatsanwaltschaft. Ist der Anzeigeerstatter zugleich Geschädigter, kann er – sollte die Generalstaatsanwaltschaft seiner Beschwerde nicht stattgeben – das sogenannte Klageerzwingungsverfahren betreiben.


Anzeigenerstatter [Bearbeiten]
Anzeigeberechtigt ist jedermann, nicht nur ein Geschädigter. Anonyme Anzeigenerstattungen sind nur auf dem nicht-persönlichen Wege möglich, da jeder Zeuge zur Angabe seiner Personalien verpflichtet ist. Anzeige gegen Unbekannt ist zulässig. Es ist auch möglich, sich selbst anzuzeigen. Von der Selbstanzeige kann auch Gebrauch gemacht werden, wenn der Anzeigende sich selbst für unschuldig hält und seine Unschuld durch eine entsprechende Einstellungsverfügung der Staatsanwaltschaft bestätigt haben möchte. Selbstanzeigen werden häufiger auch von Personen erstattet, die mit der Tat nichts zu tun haben, aber durch ihre Anzeige auf sich aufmerksam machen möchten.
Bestimmte Daten (Delikt, Tatzeit usw.) jeder Strafanzeige fließen in die bundeseinheitliche Polizeiliche Kriminalstatistik (PKS) ein. Auf den Erfassungsbelegen werden die jeweiligen Statistikschlüssel eingetragen.
In Deutschland besteht keine allgemeine Anzeigepflicht außer für Vollzugsbeamte, die zur Erforschung von Straftaten berufen sind. Von Privatpersonen muss von Gesetz wegen lediglich die Planung bestimmter, in § 138 StGB aufgeführter Straftaten angezeigt werden; siehe Nichtanzeige geplanter Straftaten. Eine Pflicht zur Anzeigenerstattung bereits begangener Straftaten besteht für Privatpersonen von Gesetz wegen grundsätzlich nicht.
Die meisten Strafanzeigen erstattet die Polizei aufgrund eigener Wahrnehmung oder durch Mitteilung, z. B. im Polizeieinsatz während der Streife oder auf einer Polizeidienststelle. Dies wird als „Amtsanzeige“ oder „Anzeige von Amts wegen“ bezeichnet. Polizeiintern trägt sie nach Erstellung den Namen „formatierte Anzeige“ und bekommt eine kriminologische Bezeichnung, gegebenenfalls mit Nennung der Strafvorschrift.
Eine Strafanzeige kann – anders als ein Strafantrag (§ 77d StGB) – nicht „zurückgezogen“ werden, da sie kein Verfahrensrecht ist, sondern ein tatsächlicher Vorgang der Kenntnisgabe, an den die Strafverfolgungsbehörden eigene Ermittlungen knüpfen.
Neuerdings ist es im Rahmen des e-Governments auch möglich, eine Strafanzeige online über das Internet, z. B. auf Portalen wie dem e-Revier[3] (virtuelles Polizeirevier der Polizei des Landes Sachsen-Anhalt), der Berliner Polizei[4], der Polizei Hessen, der Polizei Brandenburg (Internetwache Brandenburg), Polizei Nordrhein-Westfalen oder der Polizei Hamburg[5] zu erstatten.
Die aktenmäßige Behandlung von Strafanzeigen erfolgt in der Praxis durch eine Vielzahl von Dokumenten wie zum Beispiel Tatblätter, Vernehmungen, Sachverhalte, Aktenvermerke, Erklärungen, Berichten/Gutachten, Skizzen, Lichtbildmappen und Asservaten. Eine Strafanzeige erfüllt ihren eigentlichen Zweck – Einschaltung der Justiz – erst dann, wenn sie – meist über die Kriminalpolizei – bei der Strafverfolgungsbehörde eingeht. Alle bei der Polizei eingehenden Strafanzeigen werden gemäß § 163 StPO, dem Legalitätsprinzip, bearbeitet. Dies trifft jedoch nicht zu, wenn von Gesetz wegen keine Straftat vorliegt. Ferner kann der Staatsanwalt nach Abschluss des Ermittlungsverfahrens dennoch das Verfahren wegen mangelnden öffentlichen Interesses oder wegen Geringfügigkeit einstellen. Dies kann auch dann geschehen, wenn der Beweis für die Tat und Täterschaft erbracht wurde.

Mysterious Deaths of 9/11 Witnesses (MUST SEE)


I came accross this when looking for music on You Tube. I am a believer. Actually believer is a total understatement:

I have warned that the WTC was going to be attacked more then 12 different times over the years prior to the attack !

Starting in 1966. The Pentagon has me on tape as a 5 year old (in 1968) chatting about a future attack on the Pentagon and the war in Iraq. 

The US Air Force has received the correct 4 flight no.'s of the attack,  the date plus the name and adres of Mohammed Atta in Hamburg from me in 1976. (I would call that warned on time)

The German police and the Pentagon received the last warnings about the upcoming attack on sunday the 9th of 2001.

At this point 2 days before the attack, they have received again: the 4 correct flight no.'s plus the date and a very detailed description of the upcoming attack. 

People like for example Allison DuBois do really exist. They exist all over the planet.

There is no one that has to convince me, that this could have been prevented.

I too feel the urgent need to announce that 
I have NO PLANS WHAT SO EVER TO COMMIT SUICIDE
or get hit by a car by accident. But you never know.


Allison DuBois (born January 24, 1972) is an American author and medium. DuBois has claimed to possess psychic abilities and use them to help U.S. law enforcement officials solve crimes, which formed the basis of the TV series Medium.

Her alleged powers as a medium were tested by Gary Schwartz of the University of Arizona. While Schwartz claims that his research supports DuBois' psychic abilities, skeptics are quick to point out the flaws in both Allison's claims and Schwartz's research.[1] Some of her claims regarding work done in high profile investigations, such as her description of the Baseline rapist, have been shown to be either incorrect or of little investigative value.[2] Communicating with the dead and extrasensory perception are considered to be pseudoscience as there is no credible evidence to back up such claims.[3]

I came across this bit of text in Wikipedia when looking up Allison DuBois to make shure that I spell her name correct. And you know, I find the word alleged in the text incredibly annoying. 

The ability to see the future exists without any doubt. Just because the majority of people can not see it yet, that means nothing.

We can not see radio waves either but they function quite well. 
Being able to see the future very detailed like 30 years in advance, very often feels like living on the Planet of the Apes.

It is very uncomfortable to be surrounded by people who do not want to believe, simply because they can not see it.

Below an article that I have found on the internet. Just incase anyone reads this who is good with technical stuff and feels like hacking into Clarks either phone or computer stuff. Feel free to do so. The guy has committed torture and pre-meditated murder. As far as I am concerned a little hacking could not possibly be any problem. You would be helping the justice department in more then one country to find evidence.


Incase that you get caught either hacking - beaking and entering into Clarks house - kidnapping Clark or his shitbag or worse killing Clark tell whoever nags about it that it was my idea and I consider it to be perfetcly legal and self-defense !!!


Everything that I do to Clark is legal and self-defense until the Justice Departments in Europe and the US finally decide to investigate the case.


There is not much that the fucking CIA could possibly do to me that they have not already done. So I will just adjust my behaviour to theirs and I do get to kill Clark and his hysterical bitch whenever I feel like it.





AMERICAblog just bought General Wesley Clark's cell phone records for $89.95




I reported the other day that your cell phone records are on sale online for anyone to buy, without your permission. Well, this morning AMERICAblog bought former presidential candidate, and former Supreme Allied Commander of NATO (SACEUR), General Wesley Clark's cell phone records for one hundred calls made over three days in November 2005, no questions asked. (Clark's cell phone provider is Omnipoint Communications, which seems to be related to T-Mobile.)

All we needed was General Clark's cell phone number and our credit card, and 24 hours later we had one hundred calls the general made on his cell phone in November. The calls included a number of calls to Arkansas, to foreign countries, and at least one call to a prominent reporter at the Washington Post. To ensure that we actually had General Clark's correct cell phone number, we called the number this morning and the voice mail recording that answered said:

"Hi, this is Wes Clark, leave a message [unintelligible]."
We have subsequently called that number and spoken to a real person to confirm its authenticity, and to make sure General Clark was aware of this issue and what we were doing.

This is clearly outrageous. But let me first say, as an aside, that I bought my own Cingular Wireless phone records this past weekend and reported on it on AMERICAblog. I wouldn't do this to any other public person without first doing it to myself. But even after reporting on this gross violation of my (and your) personal privacy, Congress, the Administration, and the phone companies have yet to act effectively. (And they have known about it since at least this past July when the Washington Post reported on it.) So we decided to attempt to buy the records of a celebrity, so to speak. And we unfortunately succeeded.

I also want to say a quick aside about General Clark. I was a big fan of his presidential campaign, and he was the first candidate I supported. This effort was not meant in any way as a slight to the general. We wanted to see if it was possible to buy the phone records of someone high profile in order to prove that this is a problem with serious national security implications, and frankly, we didn't want to pick a Republican since we thought such a choice would be perceived as partisan or mean-spirited, and that is not our intent for exposing this. Our intent is to get this problem fixed so that we all can benefit.

I bought my records via the Web site LocateCell for $110. We bought General Clark's records via the Web site CellTolls for $89.95. It is possible that both sites are run by the same company.

Interestingly, we tried to get the cell phone records of other high-profile Washingtonians like ABC's George Stephanopoulos, the Washington Post's Dana Milbank, and the New York Time's Adam Nagourney, but LocateCell was unable to provide me with their records (possibly because those three use Verizon as their cell phone service, or possibly because LocateCell was on to me). We are in the process of trying to obtain additional records.

The following is the list we received from CellTolls detailing 100 consecutive phone calls either placed or received on General Clark's cell phone from November 15 to 18, 2005. The company only gives you 100 calls, then you have to pay more for additional calls. We have blacked out all but the last two digits of every phone number, including General Clark's cell phone number, in order to protect his privacy and the privacy of anyone he has been in contact with. This will permit General Clark, and at least one Washington Post reporter, to confirm that the record is legit.

The only question now remaining is why President Bush, our leaders in Congress, and our wireless phone companies (at the very least T-Mobile and Cingular, whose customers' records are available online to anyone) have known about this problem for at least six months but have yet to fix it.
